Terms of Service

Welcome to Chalo. These Terms of Service ("Terms") govern your access to and use of the Chalo mobile application, website (thechalo.app), and related services (collectively, the "Platform") operated by Chalo Technologies (Pvt) Ltd, a company registered under the laws of Pakistan ("Company", "we", "us", or "our").

By downloading, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

  • "Rider" means any individual who uses the Platform to request transportation services.
  • "Driver" means any individual who uses the Platform to offer transportation services to Riders.
  • "User" means any Rider or Driver who accesses or uses the Platform.
  • "Ride" means a single transportation trip facilitated through the Platform.
  • "Subscription" means the recurring monthly fee paid by Drivers for access to the Platform.
  • "Fare" means the amount charged to a Rider for a Ride.

2. Platform Description

Chalo is a technology platform that connects Riders with Drivers. Chalo is NOT a transportation company and does not provide transportation services. Chalo acts solely as an intermediary technology platform.

Drivers are independent contractors and are not employees, agents, or representatives of Chalo. The relationship between a Rider and a Driver is a direct contractual relationship for transportation services.

3. Eligibility

3.1 General Requirements

  • You must be at least 18 years of age.
  • You must have legal capacity to enter into binding agreements under the laws of Pakistan.
  • You must provide accurate, complete, and current information during registration.

3.2 Driver Requirements

  • A valid CNIC (Computerized National Identity Card) issued by NADRA.
  • A valid driving license issued by a competent authority in Pakistan.
  • A roadworthy vehicle with valid registration and fitness certificate.
  • Third-party vehicle insurance as required by Pakistani law.
  • No criminal record related to violent offenses, sexual offenses, or drug-related offenses.

4. Driver Subscription & Payment Terms

4.1 Subscription Model

Drivers may access the Platform by subscribing to one of the following plans:

  • Monthly Subscription: A flat monthly fee (currently PKR 3,000/month, subject to change with 30 days notice). Subscribing drivers keep 100% of all Fares collected.
  • Pay-As-You-Go: No upfront payment. A commission (currently 15%) is deducted from each Fare until the equivalent of the monthly Subscription fee has been collected. After the threshold is met, the Driver keeps 100% of remaining Fares for that period.

4.2 Payment Collection

Subscription fees may be collected via JazzCash, Easypaisa, bank transfer, or any other payment method supported by the Platform. Failure to pay subscription fees may result in suspension of access.

4.3 Fare Collection

Fares are set by the Platform based on distance, time, and demand factors. Fares may be collected in cash directly by the Driver or through the Platform's digital payment system. In the case of digital payments, Fares (minus any applicable Pay-As-You-Go commission) will be transferred to the Driver's designated account within 24-48 hours.

4.4 Refunds

Subscription fees are non-refundable, except where required by applicable law. Partial-month subscriptions are not prorated.

5. User Conduct

All Users agree to:

  • Use the Platform only for its intended purpose of facilitating transportation.
  • Provide accurate and truthful information.
  • Treat other Users with respect and courtesy.
  • Comply with all applicable laws, including traffic laws and regulations.
  • Not use the Platform for any illegal, fraudulent, or unauthorized purpose.
  • Not attempt to circumvent, disable, or otherwise interfere with the Platform.
  • Not harass, threaten, or discriminate against other Users.

6. Rides & Cancellations

6.1 Ride Requests

When a Rider submits a ride request, nearby available Drivers will be notified. A Driver may accept or decline any ride request. Acceptance creates a direct agreement between the Rider and Driver for transportation services.

6.2 Cancellations

Either party may cancel a Ride before the Driver arrives at the pickup location. Excessive cancellations may result in temporary or permanent restriction of Platform access.

6.3 No-Shows

If a Rider fails to appear at the pickup location within 5 minutes of the Driver's arrival, the Driver may cancel the Ride. A cancellation fee may be charged to the Rider.

7. Safety

Chalo is committed to safety but cannot guarantee the safety of any Ride. Users acknowledge that:

  • The Platform includes an SOS/emergency button that connects Users to emergency services.
  • Users may share live ride details with trusted contacts.
  • Chalo conducts basic verification of Drivers but does not guarantee Driver conduct.
  • Users are responsible for their own safety decisions, including wearing seatbelts.

8. Ratings & Reviews

After each Ride, Riders and Drivers may rate each other on a scale of 1-5 stars. Ratings are used to maintain Platform quality. Users with consistently low ratings may have their access restricted. Fraudulent or retaliatory ratings are prohibited.

9. Intellectual Property

The Platform, including all software, design, content, trademarks, and logos, is the exclusive property of Chalo Technologies (Pvt) Ltd. Users are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Chalo provides the Platform on an "as is" and "as available" basis without warranties of any kind.
  • Chalo shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Chalo shall not be liable for any disputes between Riders and Drivers.
  • Chalo's total liability shall not exceed the amount paid by you to Chalo in the 12 months preceding the claim.
  • Chalo is not responsible for the quality, safety, or legality of transportation services provided by Drivers.

11. Indemnification

You agree to indemnify and hold harmless Chalo Technologies (Pvt) Ltd, its directors, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any Ride in which you participated.

12. Suspension & Termination

Chalo may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, safety concerns, or any other reason at our sole discretion. You may delete your account at any time through the Platform settings.

13. Dispute Resolution

Any disputes arising from these Terms shall first be attempted through informal negotiation. If negotiation fails, disputes shall be resolved through arbitration in Lahore, Pakistan, in accordance with the Arbitration Act, 1940.

14. Changes to Terms

Chalo may modify these Terms at any time. Material changes will be communicated via in-app notification or email with at least 14 days notice. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan. The courts of Lahore shall have exclusive jurisdiction.
